Terms of service
Effective [Effective date]
These terms are an agreement between [Company legal name] (“Renewal Check,” “we”) and the agency or business that signs up (“you”). By creating an account or using Renewal Check, you agree to them. If you accept on behalf of an agency, you confirm you have authority to bind it.
1. The service
Renewal Check compares two commercial property insurance documents, such as an expiring policy and its renewal or a binder and the issued policy, and lists potential discrepancies with page citations. It is offered for business use by insurance professionals in the United States.
2. A reviewer’s assistant, not professional advice
Renewal Check may miss discrepancies, and it may flag differences that don’t matter. It does not replace a full policy check. Every flag is a potential discrepancy for a qualified person to review against the documents. Renewal Check does not give insurance, coverage, legal or professional advice, and it does not decide whether a policy is right for your client. You remain solely responsible for reviewing policies, advising clients and meeting your professional obligations.
3. Accounts
Keep your sign-in details secure and tell us promptly at [support@your-domain] if you think your account has been compromised. You’re responsible for activity under your account.
4. Subscriptions and billing
- The subscription is billed in advance through Stripe, either monthly or annually, and renews automatically for the same period until cancelled.
- Both billing periods include the same monthly number of comparisons, which resets each month. Unused monthly comparisons don’t roll over.
- Extra credits are one-off purchases of additional comparisons, from $50, available only while you have an active subscription. They are used after the monthly comparisons and don’t expire while your subscription is active. Unused credits lapse when the subscription ends.
- New accounts may include a small number of free comparisons, with no card required. Free comparisons have no cash value.
- You can cancel at any time from your account. Cancellation takes effect at the end of the current billing period (the end of the month, or of the year for annual plans). Subscription fees, including annual fees, and credits already paid for are non-refundable except where the law requires otherwise.
- We may change prices with at least 30 days’ notice by email. The new price applies from your next billing period after the notice period.
- Prices exclude taxes, which you’re responsible for where they apply.
5. Your documents and data
You keep all rights to the documents you upload and the results produced from them (“Customer Data”). You give us permission to process Customer Data only to provide and support the service, as described in our privacy policy. We don’t use Customer Data to train AI models.
You confirm that you have the right to upload each document, and that doing so complies with your obligations to your clients and with applicable privacy laws, including the Gramm-Leach-Bliley Act and state insurance privacy rules.
6. Acceptable use
You agree not to:
- upload documents you aren’t authorized to share, or anything unlawful or malicious;
- try to access other customers’ data, or probe, disrupt or overload the service;
- reverse engineer the service, or use it to build a competing product;
- resell or share access outside your agency without our written permission.
7. Our property
We own Renewal Check, including its software, design and documentation. These terms don’t transfer any of it to you. If you send us feedback, we may use it without obligation to you.
8. Availability and changes
We work to keep Renewal Check available and accurate but don’t guarantee it will be uninterrupted or error-free. We may change or improve features. If we make a change that materially reduces what a paid plan includes, we’ll tell you in advance and you may cancel.
9. Disclaimer of warranties
To the fullest extent the law allows, Renewal Check is provided “as is” and “as available,” without warranties of any kind, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don’t warrant that the service will find every discrepancy between documents.
10. Limitation of liability
To the fullest extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, clients or data, including any loss arising from a discrepancy the service did not flag. Our total liability for all claims relating to the service is limited to the fees you paid us in the 12 months before the event giving rise to the claim.
11. Indemnity
You will defend and indemnify us against third-party claims arising from documents you upload without authorization, or from advice or decisions you give your clients.
12. Suspension and termination
You can stop using Renewal Check and close your account at any time. We may suspend or terminate access if you materially breach these terms or fail to pay, after notice where reasonable. On termination, we delete your Customer Data as described in the privacy policy.
13. General
These terms are governed by the laws of [State], without regard to its conflict-of-laws rules, and disputes will be heard in the state or federal courts located there. If any part of these terms is unenforceable, the rest still applies. We may update these terms by giving at least 30 days’ notice by email for material changes. Continuing to use the service after that means you accept the update. These terms and the privacy policy are the entire agreement between us about Renewal Check.
